Terms and conditions – For users and buyers

1-- User Acceptance
1.1 Noëlie Ceyral Entrepreneur Individuel and her website www.noelieceyralartstudio.com provide service to you subject to the following Terms and Conditions, which may be updated by Noëlie Ceyral on a regular basis and without notice. These Terms and Conditions constitute a binding agreement between Noëlie Ceyral and you, governing your use of the Website.
1.2 By using and/or visiting the website, you agree to these Terms and Conditions.

3-- Presentation of the artworks
3.1 The artworks are presented on the website with a description enabling the buyer to know their essential characteristics and price including VAT, but excluding shipping and packing costs.
3.2 Noëlie Ceyral endeavours to display as accurately as possible the printed colours of the artworks which appear on her website, but cannot undertake to give any assurance that the colours of artworks supplied will exactly match those displayed on the buyer's monitor or home printing device. As a matter of fact, colours can vary from one monitor to another depending on the monitor’s calibration and on its characteristics. Printed colours will also vary depending on the printing format used (RVB, CMJN, Adobe 98) and on the printer used.
4-- Price and payment
4.1 The purchase price of the product is determined by Noëlie Ceyral. It is stated in Euros including VAT tax, but excluding shipping and packing costs which will be specified during the shopping cart confirmation once the shipping address is entered and validated. If customs duties, local taxes or import duties are payable, these rights are the responsibility of the buyer and under its full responsibility, both in terms of declarations and payments to the authorities and competent bodies. The buyer is responsible for enquiring with the relevant authorities about these.
4.2 Payment methods accepted on the site are: Paypal, debit or credit card, Venmo, iDEAL or Bancontact.
4.3 The buyer undertakes that all details provided on the site for the purpose of the order and its delivery are correct, that the chosen method of payment is the property of the buyer and that sufficient funds or credit facilities are available to cover the full cost of the goods ordered. Noëlie ceyral reserves the right to obtain validation of the buyer's credit card or debit card details before accepting the buyer’s order.
4.4 Noëlie Ceyral reserves the right to modify the specifications or prices of her original artworks and fine art prints at any moment and without prior notice.
4.5 Any discounts or promotions are offered subject to availability and may be terminated or amended at any time by Noëlie Ceyral. Unless otherwise agreed or stated by Noëlie Ceyral, any discounts or promotions are not cumulative, and no more than one discount or promotion shall be used on the same order.
5-- Delivery
5.1 The shipping address is the one indicated on the order. The buyer needs to make sure that he enters the correct billing address, shipping address, email address as well as telephone number in order to facilitate the delivery of the artworks he purchases.
5.2 Original artworks and fine art prints are delivered within 3 to 4 weeks.
5.3 The Buyer must inspect the goods on delivery and, in the case where goods have been delivered by courier, sign the required proof of delivery document or collection acceptance document if required. A signature on that document will constitute conclusive evidence against the buyer of receipt of the quantity of goods indicated on that document free from any apparent defect or damage. If the goods are alleged to be damaged or defective on delivery, a description of the alleged damage or defect must be given in writing at the time of delivery and signed by or on behalf of the buyer.
5.4 If the buyer wrongfully fails to take delivery of the goods, Noëlie Ceyral shall be under no obligation to refund the price of the order. If the buyer asks for a new delivery to be organized, shipping costs may be charged a second time depending on the shipping address and on the shipping company used.
5.5 The buyer can pick up original artworks purchased on the website at the artist’s studio in Bordeaux. He can choose this option at checkout when choosing the delivery mode. No shipping costs will be charged in this case. The buyer needs to contact Noëlie Ceyral before making his purchase or after it has been finalized in order to organise a time and day to pick up the artwork(s) he has purchased.
5.6 Purchased goods may not be returned to Noëlie Ceyral except as provided in conditions 7 below.
6— Import taxes and custom fees
6.1 The selling price indicated on the site does not include the possible customs charges which can be imposed by the customs authorities of certain countries. If customs duties, local taxes or import duties are due, these duties are the responsibility of the buyer and are entirely his own, both in terms of declarations and payments to the competent authorities and organizations.
6.2 In the event of non-payment of customs fees by the buyer, Noëlie Ceyral shall not be held responsible for the non-delivery of the product, for any delay in delivery or for the consequences of the buyer’s failure to pay customs duties. These costs are the responsibility of the buyer and can in no case be considered as a reason for complaint, refund or return of the product.
7 — Returns and refunds
7.1 No refunds or exchanges can be done on fine art prints as these are personalized and only printed on demand. As a matter of fact, various formats and support are available for each artwork.
7.2 The buyer shall have the right to return a purchase of an original artwork within fourteen days of receipt and ask for a refund if the item is defective or for any other reason provided they do the following:

7.22 Return the goods to Noëlie Ceyral in the condition it arrived in, via the instructions that Noëlie Ceyral sends following your email
7.23 All goods must be returned in their original packaging (which the buyer should retain for this purpose) and must be in a perfect condition.
7.24 – Noëlie Ceyral will not be held liable for any damages to any goods caused any time after receipt of the order by the buyer. Noëlie Ceyral will not be able to accept any returns of goods that have been damaged after receipt by the buyer.
7.25 – The buyer is responsible for paying the shipping costs for the return of the goods he desires to ask a refund for. Shipping costs will be charged before he can return the goods so that a return delivery can be organised. If customs duties, local taxes or import duties are due the buyer will be responsible for paying them.
7.26 – The refund will only happen once the artworks have been received by Noëlie Ceyral and once she has verified that all artworks are in perfect condition. If customs duties, local taxes or import duties need to be paid, these will also need to be paid in full by the buyer before he can receive his refund.
7.27 - No refund will be done on the original shipping costs paid when the order was placed. Only the price of the artwork will be refunded.
8— Errors, inaccuracies and omissions
8.1 There may occasionally be information on the website or in the service that contains errors, inaccuracies or omissions that may relate to descriptions, pricing, promotions, offers, shipping costs, delivery times and product availability. Noëlie Ceyral reserves the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the service, the website or on any related material or website is inaccurate. Noëlie Ceyral reserves the right to do that at any time and without notice (including after you have placed your order).
8.2 Noëlie Ceyral undertakes no obligation to update, amend or clarify information displayed in the service or on any related material or website, including but not limited to, pricing information, except as required by law. No specific update or refresh date of the service or of any related website can be specified to indicate that all information in the service or on any related website has been modified or updated.
9 -- Intellectual property rights and copyrights
9.1 All texts, images and paintings present in the site www.noelieceyralartstudio.com are the exclusive property of Noëlie Ceyral.
9.2 The contents of this site is protected by French and international copyright laws and/ or other proprietary rights and laws. All artworks and texts present on this website cannot be reproduced, modified, used, distributed, broadcasted, published or exploited for any purpose whatsoever without prior written permission from Noëlie Ceyral.
9.3 By purchasing an original painting, or a fine art print, created by Noëlie Ceyral, you do not own the copyright to this artwork. Noëlie Ceyral may continue to sell prints of any of her artworks, sold or unsold, at her own discretion. You must always request permission before using an image of a painting created by Noëlie Ceyral for any kind of use whether commercial or not.
9.4 The content of the website is provided to you as is for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcasted, displayed, sold, licensed, or otherwise exploited for any purpose whatsoever without the prior written consent of Noëlie Ceyral.
9.5 By using the site, you agree to not engage in the use, copying, or distribution of any of its content. You agree to never download or print a copy of the artworks present on this website whether for personal or commercial use.
10—Personal data and information
10.1 The information and data concerning the buyer and user are handled by Noëlie Ceyral. These are necessary for your account’s management and for your access to the service.
10.2 In accordance with article 34 of French law n° 78-17 from 6th January 1978 relative to dataprocessing, files and freedoms, you can access this information, ask for their modification or rectification or demand to no longer appear in Noëlie Ceyral’s database by sending a message to Noëlie via the contact form.
10.3 Essential cookies are being used in order to allow proper functioning of the website and more particularly the proper functioning of the e-shop that allows you to make purchases online.
11—Applicable law
These buyer and user terms & conditions are subject to the French law. Any dispute concerning their interpretation and/or execution will be subject to the French jurisdiction.
